By using our site, you indicate that you accept these terms of use and that you agree to abide by them. You are strongly urged to leave the website immediately if you do not agree with the terms outlined.

Information about us

This site is operated by Phoenix Multimedia Productions Ltd. We are a registered company in England and Wales, company number 06962337 and have been trading since July 2009 on behalf of The UK Dog Whisperer who are responsible for day-to-day running of the content published.

Accessing our clients site

Access to The UK Dog Whisperer website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.From time to time, we may restrict access to some parts of our site, or the entire site.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Images of people or places displayed on our site are either the property of, or used with permission by us. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these terms of use or specific permission provided elsewhere on our site. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

Our liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

Information about you and your visits to our site

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Linking to our site

You may link to The UK Dog Whisperers home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law.

Trade marks

The trademarks, logos, and service marks (collectively the Trademarks) displayed on our site are registered and unregistered Trademarks of ours and others. Nothing contained on our Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on our Site without our written permission or the written permission of such third party that may own the Trademarks displayed on our Site. Your misuse of the Trademarks displayed on our Site, or any other content on our Site, except as provided in these Terms and Conditions, is strictly prohibited. You are also advised that we will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

Intellectual Property Rights.

The structure, the theoretical information, and the advice shared on any of our dog psychology courses is the intellectual property of The UK Dog Whisperer Ltd. Any part of the information offered by our company, cannot be replicated in any form without the prior consent from the company. Any agent, employee, or third party, that offers our property without consent will be considered as infringing our copyright. Our courses are considered to be private events that are attended by those who have either paid for the privilege, or have been personally invited by the company. As such, no recording of the courses is permitted in any format, unless otherwise agreed. Any person found to be recording any part of the course material, can be expelled from the course, with no refund, remuneration, liability, or compensation being made by the company to the individual.

Variations

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

TERMS AND CONDITIOND REGARDING COURSES AND WORKSHOPS

Any person applying to attend ANY course, regardless of whether it is booked directly through The UK Dog Whisperer Ltd, or via a third party agent, MUST BE OVER THE AGE OF 16 when the course commences. Anyone under the age of 16 will require to be accompanied by a guardian over the age of 18. There will be an additional charge for the guardian to attend. TERMS & CONDITIONS REGARDING COURSES, BOOKINGS, PAYMENTS AND CANCELLATIONS FOR DIRECT SALES (NOT VIA A THIRD PARTY).

EVENING CLASSES: These are subject to our general terms and conditions, with the exception of

  1. There is a one off single payment of the price advertised. To be paid on completion of the reservation process.
  2. There is a 7 day period after the reservation has been processed to request a refund in full, minus a £20.00 administration charge. After the 7 day period has elapsed ALL MONIES ARE NON REFUNDABLE. (Separate terms and conditions apply to combination offers that include a level 2 Practical Application Workshop. See conditions below). Any request for a refund must be made in writing to info@theukdogwhisperer.com
  3. Anyone not attending all or part of the evening classes advertised will not be remunerated in part or in whole of any monies paid.

GENERAL REFUNDS

1.1 LEVEL 1 & 2 REFUNDS: Any other legitimate refunds for a level 1 course are subject to a£10.00 administration fee. Any other legitimate refunds for a level 2 course are subject to a£10.00 administration fee.

2.0  All refunds will be via the original payment gateway and may be subject to further bank charges, we cannot be held accountable for any third party additional charges.

2.1 In the unlikely event that the course doesnt take place, you will be offered alternative dates.

If you cannot attend any course, you will be offered all available alternative courses within the particular level of course you booked. Any outstanding balance that is due on the original booking must be paid by the original course commencement date (Not the alternative course commencement date).

PLEASE NOTE: IN THE EVENT OF A CUSTOMER NOT ATTENDING THE CHOSEN COURSE, THE COMPANY IS UNDER NO OBLIGATION TO OFFER AN ALTERNATIVE OR REPLACEMENT BOOKING, BUT OFFERS THIS EXTRA SERVICE AS A COURTESY. THE COMPANY CANNOT BE HELD RESPONSIBLE IF NO ALTERNATIVE IS AVAILABLE.

Level 1. If level 1 courses or workshops are below £150.00, no deposit is required as payment is expected in full.  After your initial payment you have up to 7 days to change your mind and request your payment be refunded, and your reservation cancelled. After this 7 day period, your payment is non refundable (to a maximum of £150.00). Once any course commencement date is within 7 days (level 1 or 2 or workshop), you understand and agree that ANY payment is non-refundable. All cancellations are required in writing.

If you have purchased a discount voucher from a third party, then any refund is subject to the third parties terms and conditions. Terms and condition particular to voucher purchases can be found below.

Should you not attend the Course on which you have reserved a place, and fail to give us notice, in writing a minimum of 72 hours before said Course, we reserve the right to impose an administration fee of £25.00 in order to reschedule your reservation. (This applies to all courses. Level 1, 2, 3, and the ‘Work Experience Day’).

Level 2: You have up to 7 working days after making your first payment to change your mind and request your payment be refunded, and your reservation cancelled. After this 7 day period, any deposit paid (to a maximum of £120.00) is non refundable.

If you have paid in full, the deposit is included in the full price, and the deposit (£120.00) is non refundable.

If a purchaser wishes to cancel AFTER the initial 7 day cancellation period, any monies paid will have an additional £99.00 per applicant deducted from any other payment or balance payment. Any refund issued will also incur a £10.00 administration fee.

Once the course commencement date is within 7 days, you understand and agree that ANY payment is non-refundable.

All cancellations are required in writing.

 

2.2 level 2 BALANCE PAYMENT

Applicants have up to 7 days prior to the course commencement date to defer their chosen level 2 course to a later available and advertised date. Once your booked course commencment date is within this 7 day period, any payment made is non-refundable. In the event that a course date has been deferred by the purchaser, terms and conditions are applicable to the first course selected, not the new date.

Level 2: Once a Level 2 course date is within 7 days of commencement, any outstanding money due must be paid prior to the commencement date.

The company has the right to refuse admittance to anyone still owing any outstanding payment.

Unrequested refunds of any payments will only be offered in the unlikely event that the course does not take place.

If you cannot attend any course, you will be offered all available alternative courses within the particular level of course you booked. Any outstanding balance that is due on the original booking must be paid by the original course commencement date (Not the alternative course commencement date).

In the event that a purchaser cannot attend a level 2 course, alternative level 2 dates will be offered. The purchaser can change the dates up to maximum of 2 times after the original course date. The purchaser must choose their alternative dates, and attend a course, within 6 months of the original date. After the 6 months time period has elapsed, the company (The UK Dog Whisperer Ltd, or any other associated company) is under no obligation to offer further alternative course dates, or be liable for refunds of any kind.

ONCE A COURSE HAS COMMENCED

2.3  Should you commence the course and then decide not to complete the training, we will not refund any of the tuition fees in whole or in part, as you would have taken a place on the course that could have been allocated to another student.

2.4  NON CONFIRMATION OF ATTENDANCE. A reminder email will be sent to all those booked on  a course, prior to the commencement date. If the expected attendee does not reply confirming their attendance, then it will be assumed they are not attending. In this case, a diploma will not be printed for the attendee. Should they then attend, and on completion of the course, they request a diploma, then a there will be a charge of £5.00 for an electronic diploma or£10.00 for a printed diploma, and postage. Requesting a diploma should be via an email to our office.

2.4  NON ATTENDANCE. If an applicant does not attend the course, or attends part of the course, then any outstanding monetary balance payment from the applicant will still be due, as their place was reserved, booked, and confirmed, and full payment will be demanded. If the applicant has paid in full, no refund will be offered.

The UK Dog Whisperer Ltd and any representative of the company has the right to refuse entry to a course if any money due is outstanding.

If a student does not attend, then any outstanding money due must be paid within 10 days of the commencement date.

  1. We do not offer in whole or in part any remuneration whatsoever related to travel expenses, B&B or hotel accommodation or time taken off work or accidental injury to persons or property or livestock, or dogs or loss or damage to personal property under any circumstances.
  2. You may not be admitted to the classroom if you have not paid in full before the class commences so please insure that you have funds available prior to commencement. You must pay the balance either in cash on the first day of the course, or by making a card payment over the phone prior to the commencement date. ATTENDING DOGS

  1. You are responsible for the wellbeing and care of your dog at all times. This also includes cleaning up after your dog has soiled. You agree that you are solely responsible if your dog causes damage or injury to a third party human animal or property, we do not accept responsibility for your dog and you agree to offer remuneration to any such third party should an incident occur involving you or your dog.
  2. All terms and conditions may be subject to change without prior notice and may be considered only current at the time of issue. All current company terms and conditions of sales and operations will be made available to you on request.

6.1  All terms and conditions issued herein and later amended applies to all students, guests, dogs  and customers without exception.

6.2  We will not be held liable for any damage, injury or loss of any kind to person, animal, or possession, unless included as part of a demonstration that is controlled by an employee of the company. Students who choose to engage with dogs, or choose to introduce dogs to other dogs, while not part of an employee controlled environment, do so completely at their own risk, and our company, or any employee cannot be held accountable.

  1. We do not accept responsibility for any student practicing our training techniques without supervision of the tutor outside of the classroom. We will not indorse the commercial use of our training techniques to any student without our written permission.

7.1  We do not accept responsibility for any damage to students dogs, or students,  personal or commercial clients dogs, or persons or property, or livestock,  should the student misunderstand or misinterpret or misuse our training techniques and commercially or privately practice our training techniques with or without our written permission outside of the classroom.

A booking through a third party agency.

Voucher Purchase:

Terms and conditions of your current purchase.

 

  1. By purchasing a voucher via one of our agents and contacting us, your place has been reserved for you on our Level 1 course only, however should you have a change of plans and be unable to attend on the dates that you have booked, you will be offered alternative dates provided that you contact us within one week of the original booking date. Alternative dates may not be at the same location as the original booking and all places on our courses are subject to availability. Alternative dates can be between 1 week to 12 months after the original booking. All dates are advertised on our website.
  2.  Terms and conditions of voucher refunds are available from the agent that you purchased from.

2.1  Should you purchase a discount voucher but then decide the course in not what you would like to attend, then you must ask the voucher company for an alternative voucher BEFORE completing our application form. Once we receive your application form you have committed to the course, and we will not be held liable for any monetary remuneration should you change your mind about attending.

2.2  Should you commence the course and then decide not to complete the training, we will NOT refund any of the tuition fees in whole or in part as you would have taken a place on the course that could have been allocated to another student, and you attended with the understanding that you made a commitment, and that we will NOT offer any monetary remuneration.

  1. We do not offer in whole or in part any remuneration whatsoever related to travel expenses, B&B or hotel accommodation or time taken off work or accidental injury to persons or property or livestock, or dogs or loss or damage to personal property under any circumstances.
  2. You will not be admitted to the classroom if you have not paid in full before the class commences so please insure that you have funds available, cash payments are preferable. You must pay the balance ether in cash on the first day of the course, or by going back again to the website no later than seven days prior to the start of the chosen course and making your balance payment online.. You will get an instant receipt from PayPal to your email address for all card payments and PayPal payments, and we will also acknowledge your payment by email with confirmation of your reservation on the tutorial. If you would prefer to make a card payment over the phone you can call us on 07496 76 88 89 Monday- Friday 9.00am-7.00pm, and Sunday 10.00am-4pm

  1. If you do not cancel your booking within 7 working days of paying your deposit then it will be assumed that you have read and understood all terms and conditions and you agree to abide by them.

DIPLOMAS AND CERTIFICATES

As from 30th of January 2017. Diplomas and/or Certificates may be provided to the student on successful completion of any achievement via email (e-copy). The e-copy will be sent as an attachment to an email to the email address provided on the application. The UK Dog whisperer Ltd cannot be held responsible for non receipt of an e-copy, should the email address be invalid. E-copies are included in the cost of the course or service provided.

A paper copy can be provided (hard copy) as an additional cost to the student, and is not included in the cost of the course or service provided. The cost is £10 payable in advance. The request for a hard copy must be made in writing to theukdw@gmail.com and the accuracy of any details, such as name, location and/or dates are the responsibility of the person requesting the hard copy. The UK Dog Whisperer Ltd cannot be held responsible for any errors in the information provided, and a replacement copy will not be issued free of charge if the information is incorrect.
